of 2014 pending before the Metropolitan Magistrate, 19th Court, Calcutta has already been dismissed vide order dated 9th August, 2023 and the accused persons are discharge under Section 245 (2) of Cr.P.C.

In such view of the present application has became infructuous.

Learned Counsel appearing on behalf of the opposite party no.2 submits they have preferred revisional application before the Sessions Judge against that order of dismissal which is presently pending for disposal.

In view of aforesaid submissions, let CRR 2791 of 2015 is dismissed being infructuous. Application, if any, pending is also dismissed. However liberty is given to the petitioner to take out fresh application if situation demands.
