10.09.2024 AD-48 Court No.29 TN (Allowed) CRM (A) 3199 of 2024 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 read with Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Joypur Police Station Case No. 157 of 2024 dated 09.05.2024 under Sections 448/325/307/354/506/34 of the IPC, 1860.
And In the matter of: Rabi Kisku and another .... petitioners Mr. Arunava Ganguly ....for the petitioners Mr. Subrata Roy, Mr. Aritra Bhattacharya ....for the State 1.
Claiming parity with co-accused persons, namely, Aparupa Murmu & Ors. who were granted anticipatory bail in CRM (A) 2287 of 2024 on 10th July, 2024 and Pradip Murmu who was granted anticipatory bail in CRM (A) 2959 of 2024 on 28.08.2024, which is not being disputed by the State, we are inclined to grant anticipatory bail to the petitioners. 2.
Accordingly, we direct that in the event of arrest, the petitioners, namely, Rabi Kisku and Anup Saren respectively shall be released on bail upon furnishing a bond of Rs.10,000/- each, with two registered sureties of like amount each, to the satisfaction of the arresting officer, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973, corresponding to Section 482(2) of the BNSS, 2023.

The petitioners shall meet the Investigating Officer once in a week till submission of the final report.

The petitioners shall appear before the learned Additional Chief Judicial Magistrate, Bishnupur within two weeks from date and thereafter shall appear on each and every date of hearing.

In the event the petitioners fail to comply with any of the conditions as mentioned above, the trial court shall be at liberty to cancel his anticipatory bail in accordance with law without any further reference to this court.

Accordingly, the prayer for anticipatory bail of the petitioners is allowed.
