Heard learned counsels for the parties.

It is contended on behalf of the petitioners that the petitioners were granted lease in respect of two jalkars, namely, "Pabiya Beel" and "Kalapahar" on and from 1423 BS, but were unable to hold pisciculture therein due to several litigations between the petitioners and others. The petitioners have prayed for extension of the period of lease before the concerned authority by a representation filed on 17th September, 2019 and pray for a direction upon the authority to consider the representation at the earliest.

It is submitted on behalf of the respondents that the 4th respondent may be directed to consider the representation, in accordance with law.

In view of the above, the writ petition is disposed of directing the 4th respondent to consider and dispose of the representation submitted by the petitioners dated 17th September, 2019 within one month from the date of communication of this order after affording a reasonable opportunity of hearing to all the interested parties including the petitioners, in accordance with law. The decision taken by the authority shall be communicated to the petitioners within a week thereafter. It is made clear that this Court has not gone into the merits of the case and the petitioners shall be at liberty to place their contentions before the appropriate authority at the time of hearing.

With the above observations and directions this writ petition being WPA 21945 of 2022 is disposed of. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
