Mr. Rajashree Tah ...for the petitioner Mr. Pantu Deb Roy Mr. Subrata Guha Biswas ...for the State Report filed on behalf of the State is taken on record. ssi Ct 14 Learned counsel appearing on behalf of the petitioner submits as follows. Initially the writ petition was filed for transferring the investigation to the CID. However, in the meantime, a charge sheet has been submitted although not against all the accused. Investigation has not been done properly. The former BL & LRO who was made an accused in the FIR has not been charge sheeted.

Learned counsel for the State submits as follows. The allegations made in the writ petition are denied. After meticulous investigation, a charge sheet has been submitted. Due reason has been cited as to why the BL & LRO was excluded from the array of the accused. Perused the case diary.

It appears that a charge sheet has already been submitted. However, against some of the accused. Therefore, the main prayer of the petitioner in the writ petition has become infructuous.

However, if the petitioner/defacto complainant is aggrieved with the outcome of investigation, he shall be at liberty to file a protest petition, which shall be decided in accordance with law.

With these observations, the writ petition is disposed of without costs.
