Report filed on behalf of the State is also taken on record. A copy of the same is handed over to learned advocate for the petitioner.

Learned advocate appearing for the petitioner submits as follows. The petitioner had lodged an FIR regarding cyber fraud committed in the year 2017. Initially, a final report was submitted on 10.01.2019. Upon a protest petition being filed by the petitioner on 03.02.2022, learned Chief Judicial Magistrate, Bankura directed further investigation into the case to be conducted by the Inspector-in-Charge of Cyber Crime Police Station, Bankura. However, till date no progress has taken place.

Learned advocate for the State relies on the report and submits that the investigation is still continuing. However, the investigating agency is finding it difficult

because the whatsapp chat was deleted soon after the offending messages appeared.

The further investigation of the case shall be conducted by Cyber Crime Police Station, Kolkata. The investigating agency shall conclude the investigation expeditiously and in accordance with law. With these observations, the writ petition is disposed of.

Urgent certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
