Heard learned counsels for the parties.

The petitioner seeks transfer of Misc. Case No.157 of 2024 pending before the learned Judicial Majistrate, Haldia, Purba Medinipur on the ground that the local bar is hostile towards him and there is no learned advocate who is ready and willing to represent him before the learned Trial Court.

Learned counsel who travelled from Kolkata on one occasion was also restrained from appearing before the Court on behalf of the petitioner. As such, the petitioner is unable to contest the Misc. case.

Learned counsel for the opposite party submits that the case may be transferred to any Court in Paschim Medinipur.

Upon consideration of the submission made on behalf of the parties the Misc. Case No.157 of 2024

pending before the learned Judicial Magistrate, Haldia, Paschim Medinipur be transferred to the Court of learned Chief Judicial Magistrate, Paschim Medinipur for trial. The learned Magistrate, Haldia is directed to transmit the case record along with annexure thereto to the Court of the learned Chief Judicial Magistrate, Paschim Medinipur at the earliest.

The learned Chief Judicial Magistrate, Paschim Medinipur shall either deal with the case himself or assign the same to any other Magistrate within his jurisdiction for trial.

The revisional application being CRR 3792 of 2024 is disposed of.

As a consequence, the application being CRAN 1 of 2024 is also disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
