A report has been submitted by the State which reflects that since the offence complained of was not cognizable offence, the police authorities took permission from the learned ACJM, Barrackpore, thereafter, registered Naihati PS NCR No. 855/25 dated 15.09.2025 under Section 115(2) of the BNS.

Having regard to the fact that the

police authorities have already taken steps and issued notice under Section 94 of the BNSS to the petitioner, it would be for the petitioner, in the interest of justice, to cooperate with the investigation so that the investigation can be taken to its logical conclusion.

If the petitioner is aggrieved regarding any action of the police authorities, he would approach the jurisdictional Magistrate under the relevant provisions of law and the learned Magistrate would assess as also ascertain regarding the grievance of the petitioner, thereafter, take steps in accordance with law.

Since the information furnished by the petitioner reflects that the dispute between the landlord and occupant still exists, it is bound to have a strained relationship.

Consequently, the police authorities would oversee that no breach

of peace and/or tranquility takes place.

With the aforesaid observations, WPA 21712 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the petitioner.
