Petitioner Mr. Bhaskar Chakraborty, Mr. Subrata Mukherjee, Mr. Surajit Maity .. for the Petitioner Being aggrieved and dissatisfied with the order dated 29th November, 2023, petitioner has preferred the instant application. By the impugned order, learned Court below issued warrant of arrest against the present petitioner. It is submitted that learned Magistrate, issued warrant of arrest without recording his satisfaction that the petitioner against whom warrant of arrest was issued had any information about the next date and whether the surety served any notice upon him. However, he wants to surrender before the Court below.

Having heard the learned Counsel for the petitioner the instant application being CRR 4208 of 2025 is hereby disposed of giving liberty to the petitioner to surrender before the Court below within a period of two (2) weeks from date, and in the event of such surrender by the petitioner, the

court below will dispose of his prayer in accordance with law, without being influence by any observation made herein. The impugned order dated 29th November, 2023 by which the Court below issued warrant of arrest shall be stayed for a period of two (2) weeks or till the petitioner surrenders before the Court below, whichever is earlier.
