Mr. Chitta Ranjan Chakraborty, Mr. Dip Jyoti Chakraborty .... For the O.P No.2 None appears for the petitioner when the matter is called 31.10.2022 BMJR Item no. 38 Ct. No.35 on. Learned advocate on behalf of the O.P No.2 is present in Court. It appears that the matter is pending in the list since 06.09.2022 and no one appeared for the petitioner since then in spite of the fact that the matter was called on each day since thereafter. Therefore, without wasting any further time this Court is intended to take the matter for disposal on merit in absence of the petitioner.

The petitioner who is the accused person in Coke Oven Police Station Case No.61 of 2015 dated 1st May, 2015 under Section 367 of the Indian Penal Code corresponding to G.R Case No.776 of 2015 has preferred the present revision case praying for an order to quash the said criminal proceeding.

O.P No.2 is the husband of the victim who has made a complaint in the case alleging serious nature offences against the petitioner. While praying for quashing the criminal proceeding

against her and defiance the allegation against her, the petitioner has come up with several grounds as mentioned in the present application.

However, after carefully going through the same and the documents available in the record, I am of the opinion that the grounds pleaded are not sufficient to warrant an order from this Court as prayed for by the petitioner. This entails the present revision to be dismissed being without merit. Hence, on the discussion, as above, the present case being CRR 2813 of 2015 is dismissed being devoid of merit. In view of the dismissal of the revision petition, the application being CRAN 1 of 2015 (Old No. CRAN 4114 of 2015) is also dismissed. Interim order, if any, stands vacated.
