A response from the concerned authority of WBUHS sent to its learned counsel, as filed in Court, is taken on record.
It appears that the WBUHS admits a technical glitch in their affiliation portal which has resulted in non-inclusion of BScMLT course at HIHS in the seat matrix of counselling of JENPAS-UG, 2024. As the choice filling for first round of counselling had started on last Friday and is to end soon, learned counsel for the WBUHS submits that WBJEEB may be asked to notify all concerned candidates to fill their choices
after inclusion of 60 unreserved sits in BScMLT course at Haldia Institute of Health Sciences in the seat matrix. Learned counsel appearing on behalf of the WBJEEB submits that it is not possible to effect the necessary changes in course of half a day. The counselling ends tomorrow i.e., on 04.09.2024. However, the college and the students can be given consequential benefits of participation in the second and/or mop up round of counselling after incorporation of necessary changes in the seat matrix.
Learned counsel for the State adopts the stand taken by the learned counsel for the WBJEEB.
Learned counsel appearing on behalf of the petitioners relies on an order dated 29.08.2023 passed by a Coordinate Bench of this Court in WPA 21027 of 2023.
It is unfortunate that for a mistake committed at the end of the WBUHS, the college and the students are having to suffer.
As the last date for filling up choices is on tomorrow i.e., 04.09.2024 and the WBUHS has not even come up with an official order effecting necessary correction in respect of the seat matrix, it will not be prudent to halt the process of first round of counselling.
However, in the interest of justice it will be appropriate for the WBUHS and the WBJEEB to effect necessary corrections in the seat matrix as referred to above for further counseling at the earliest. They shall arrange for holding a second round of counseling on the corrected seat matrix. The concerned authorities of the WBUHS and the WBJEEB shall
assist the College and the students, facilitate the entire process and take necessary steps for permitting such counselling on the dates fixed i.e., between 06.09.2024 and 10.09.2024. If necessary, the respondent authorities shall be at liberty to extend the date of counselling. With these observations, the writ petition is disposed of.
