Mr. Supratim Dahr, Advocate ......for the Petitioner Mr. Soumitra Bandopadhyay, Advocate Mr. Priyabrata Batabyal, Advocate ......for the State It is really unfortunate that an application for condonation of delay filed in a proceeding initiated in the year 2020 is still pending in the docket of the Tribunal and the next date is fixed on April 4, 2023. We have noticed in the past that the Tribunal is fixing date after a gap of nearly one year even in respect of a matter which could have been disposed of on the same day.

The application under Section 5 of the Limitation Act should have been disposed of at an early point of time and we do not subscribe to the view of the Tribunal that the hearing of the said application be fixed after a gap of more than seven months.

We, therefore, direct the Tribunal to fix a date for hearing of the said application which should not exceed fifteen days from the date of communication of this order in presence of the parties and shall thereafter make efforts to dispose of the same within a month therefrom in accordance with law. With these observations, the writ-petition being WPLRT 145 of 2022 is disposed of. No order as to costs. (Harish Tandon, J.) (Prasenjit Biswas, J.)
