In Re : Md. Jakkar Ali ....Petitioner Mr. Robiul Islam Mr. Shamim Ul Bari ......for the petitioner The grievance of the present petitioner relates to warrant of arrest which was issued by the learned Special Judge, Malda on 22nd April, 2022.
The petitioner apprehends that he may be arrested in the mean time.
The orders which have been enclosed along with the revisional application show that on 29th August, 2022 the learned Magistrate fixed the date on 7th November, 2022 for execution of return of the said warrant of arrest.
Learned Advocate for the petitioner expresses his intention to surrender before the jurisdictional Court being the learned Special Judge, Malda. In view of the aforesaid, the petitioner is directed to serve a copy of the revisional application upon Mr. Arijit Ganguly and Mr. Subrato Roy, learned
Advocates who ordinarily appears on behalf of the State.
Their appointments may be regularized by the concerned authority.
In view of the prayers so advanced, the execution of the warrant of arrest so issued be stayed till 8th November, 2022.
If the petitioner surrenders before the learned Special Judge, Malda within the aforesaid period, the learned Special Judge, Malda will consider the application for bail in accordance with law. In case, the petitioner do not surrender before the Learned Special Judge, Malda by 8th of November, 2022, the Learned Special Court would be at liberty to proceed to the next stage and issue harsher process of law on 9th of November, 2022.
With the aforesaid observations, CRR 3618 of 2022 is disposed of. Pending application, if any, is consequently disposed of.
Learned Special Judge, Malda is directed to act on a server copy of this order dully obtain from the official website of the Hon'ble High Court, Calcutta. All parties to act on server copy of this order, duly collected from the official website of the Hon'ble High Court, Calcutta.
