Being aggrieved and dissatisfied with the judgment and decree dated 15th June, 2015 passed by the learned Additional District Judge, 12th Court, Alipore, South 24 parganas in Title Appeal No. 130 of 2005, the present application has been preferred. The Trial Court by the impugned judgment was pleased to set aside partially the judgment and decreed dated 20th May, 2005 passed by the learned Civil Judge, Senior Division, 8th Court, Alipore in Title Suit no. 11 of 1993.
During pendency of the second appeal, good sense prevailed among the parties and they have come forward with an amicable settlement being
Annexure-A of present application being CAN 1 of 2024 and the parties now pray for passing decree in terms of said compromise petition being Annexure-A of CAN 1 of 2024.
Perused the terms of settlement which appears to be lawful and as such the present Second appeal being SAT 414 of 2015 is hereby decreed in terms of compromise being Annexure-A of present application. Let Annexure-A of present application being CAN 1 of 2024 be made part of the decree.
SAT 414 of 2015 along with CAN 1 of 2024 are accordingly disposed of.
Parties will bear their own costs and as prayed, the parties are given liberty to take back the original trust deed for the year 1957, on production of certified copy of the same from this court.
Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
