Alauddin Mondal, Advocate ......for the Petitioner Mr. Soumitra Bandopadhyay, Advocate Mr. Subhasis Bandopadhyay, Advocate ......for the State The only grievance raised in the instant writ-petition is the delayed disposal of the tribunal application pending since 2017. The order dated 06.09.2022 would reveal that the tribunal proceeding is otherwise ready for final disposal and has been posted for hearing on 25.11.2022. It appears that the matter was lastly listed on 06.09.2022 but could not be taken up because of paucity of time. The said order would further reveal that notes of argument were filed by the applicants and, therefore, there was no impediment on the part of the Tribunal to take up the matter on the said date and dispose of the same. The matter is unnecessarily lingered on despite notes of argument being filed which would frustrate the legislative intent behind the establishment of the Tribunal under the Constitutional provisions.

Since the Tribunal is going to be closed for ensuing Puja Vacation and shall reopen on October 31, 2022, the next date so fixed appears to be in close proximity of the reopening day.

We, therefore, request the Tribunal to take up the matter on the said date so fixed and dispose of the same within two weeks thereafter by recording proper reasons

and in accordance with law after affording opportunity of hearing to the respective parties.

With these directions, WPLRT 146 of 2022 is disposed of.
