Petitioner Mr. Pradyut Saha ... for the petitioner Learned Advocate appearing for the petitioner submits that during the Covid, ACM No. 412 of 2021 was preferred before the jurisdictional Court. Presently, the said case being ACM 412 of 2021 is pending before the ld. JM, 1st Court, Alipore.

Ld. Advocate submits that although the case was filed almost two years ago, but till date, the application of the petitioner for interim maintenance has not been disposed of by the ld. Magistrate.

Ld. Advocate submits that the last date is fixed on 8th of September, 2023 and Affidavit-of-assets, on behalf of both the parties, have already been exchanged. Having considered the same, I direct the ld. Trial Court to dispose of the application for interim maintenance preferably on 6th of December, 2023 or, at least within a fortnight thereafter (21st December, 2023).

None of the parties would be allowed by the ld. Magistrate to adopt any means by which the aforesaid time period can be stretched.

With the above observations, CRR 3411 of 2023 is disposed of.
