The petitioner has preferred the present writ petition being aggrieved by the non-payment of gratuity and arrears of pension with effect from March, 2023 to June, 2024 along with interest and other retirement benefits to the petitioner, despite the issuance of the Pension Payment Order (PPO) being no. 14019920240134, dated June 21, 2024. It is the case of the petitioner that he was appointed as Casual Employee under Garulia Municipality (respondent no. 3), as Drain Coolie under Conservancy Department of the Municipality. His service has been approved by the authority concerned with effect from May 01, 1986 against the Sanctioned Vacant Post. Since the date of joining, he has been continuously worked in his respective post of the municipality for long 33 years at a scale of pay which has been regularly enhanced along with admissible benefits, which are evident

from the service book of the petitioner. Ultimately the petitioner retired from the service of the Municipality with effect from 28.02.2023 due to superannuation of age. The Director of Pension, Provident Fund and Group Insurance, Finance Department, Govt. of West Bengal, issued a Pension Payment Order, dated June 21, 2024 addressed to the Chairman, Garulia Municipality, respondent no. 4. Inspite of the said order he has not yet been received his respective claims regarding gratuity, arrear pension with effect from March 2023 to June 2024 along with interest and other retiral benefits till date.

Learned Advocate appearing for the respondent Municipality submits on instructions from Mr. Mujibar Rahaman, Executive Officer, Garulia Municipality that partial payments towards the retiral benefits have already been disbursed to the petitioner. It is further contended that the rest of the amount which is due and payable to the petitioner shall be released within a period of eight weeks from the date of communication of the order. The respondent-municipality shall remain bound by the statement made before this Court. In view of the assurance given by the learned Counsel for the respondent municipality, the present writ petition stand disposed of by directing the respondent Garulia Municipality to strictly adhere to the statement made before this Court and to ensure the release of the remaining pensionary dues, including gratuity and arrears of pension, within a period of 8 weeks from the date of communication of this order.

In view of the above direction, the present writ petition is disposed of.
