The petitioners seek release of payment of the amount in terms of the work order dated 5th March, 2019 in connection with work order for Serial No. 19 of NIT No. 1619/PWD(BMC) dated 21.12.2018, Tender ID. 2018_MAD_203040_19.

After the work order was completed, part payment has been made to the petitioners. The petitioners seek payment of the balance amount. Representation filed by the petitioners is pending consideration at the end of the Bidhannagar Municipal Corporation.

Without entering into the merit of the claim of the petitioners, the instant writ petition is disposed of by

directing the Commissioner, Bidhannagar Municipal Corporation to consider the representation made by the petitioners in accordance with law, after giving a reasonable opportunity of hearing to the petitioners at the earliest, but positively within a period of twelve weeks from the date of communication of this order. If any amount is found due and payable, the same shall be released at the earliest.

Learned advocate appearing for the petitioners is directed to forward a copy of the representation dated 5th July, 2023, work order dated 5th March, 2019 and other documents in support of the claim to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
