The affidavit of service filed by the petitioner is taken on record.

The petitioner alleges that Respondent No. 5 has disconnected the electricity line which the petitioner has been enjoying for the past 25 years. Learned counsel for the petitioner submits that the petitioner's daughter is an examinee of the ongoing Higher Secondary Examination 2025 and, as a result of the disconnection, she is facing significant difficulty in preparing for her examinations. Learned counsel appearing for the West Bengal State Electricity Distribution Company Limited (WBSEDCL) submits that the disconnection was not caused by WBSEDCL but by Respondent No. 5, who is the petitioner's brother. It is further submitted that officials of WBSEDCL

have, on multiple occasions, visited the premises to restore the connection; however, their efforts were obstructed by Respondent No. 5, preventing reconnection.

Respondent No. 5 denies the allegations and asserts that he did not disconnect the electricity line. It is further alleged that the electricity wire providing connection to the petitioner runs over the roof of Respondent No. 5's premises, and due to this wiring, the wife of Respondent No. 5 suffered electrocution on one occasion. It is also submitted that the property in question is a jointly owned property which has not yet been partitioned by metes and bounds. The co-sharers in the property have been enjoying separate electricity connections for their respective premises.

Respondent No. 5 submits that he has no objection to the restoration of the petitioner's electricity connection, provided that the line is shifted through a common pathway running through the property in question.

In view of the above, this writ petition is disposed of with the following directions:

WBSEDCL is directed to restore the electricity connection within 48 hours from the date of this order as an emergency measure. To implement this order, WBSEDCL officials are authorised to seek police assistance from the local

police station, with the costs of such assistance to be borne by the petitioner.

After restoration, WBSEDCL officials shall relocate the electricity line so that it does not run over the roof of Respondent No. 5's premises. The connection shall be realigned through a common passage to be identified by the petitioner and Respondent No. 5.

The realignment of the line shall be completed within four weeks from the date of this order. The necessary costs for such realignment shall be borne by the petitioner.

Accordingly, writ petition being WPA 21682 of 2025 is disposed of.
