Re : An application under Section 482 of the Code of Criminal Procedure. The subject mater of the revisional application relates to an order dated 29th June, 2009 passed by the learned Judicial Magistrate, 1st Court, Malda in Case No. 615-C of 1994 under Section 135 of the Customs Act, 1962. Record of the revisional application reflects that the revisional application was admitted on 25th November, 2009 and the direction was passed to effect service upon the opposite parties. However, there is no interim order staying the proceedings in the court below.

Today, when the matter has been called, none appeared on behalf of the petitioner and no information has been furnished to this court regarding the present stage of the complaint case, which is under challenge before the learned trial court. Having regard to the fact in the revisional application the foundation of challenge involves a mixed question of fact and law, I am of the opinion that no interference is called by this court at this stage. Accordingly, the revisional application being CRR 3552 of 2009 is

dismissed.
