Learned advocate appearing for the petitioner is directed to serve copy of this revisional application upon Mr. Arijit Ganguly, learned advocate, who ordinarily appears for the State. His appointment may be regularised by the concerned authorities.

There was a direction by the learned Chief Judicial Magistrate, Howrah for appearance of the Investigating Officer of the case and the Inspector-in-Charge of Jagacha Police Station.

Mr. Ganguly, learned advocate for the State is directed to communicate with the Deputy Commissioner of Police incharge of Jagacha Police Station who would take steps so that the Inspector-in-Charge, Jagacha Police Station and the Investigating Officer of the case are present before the learned Chief Judicial Magistrate, Howrah in connection with the explanation so called for in Jagacha Police Station Case No. 364 of 2014.

If the officers are of the opinion that their report is substantiated, the officers would be at liberty to stick to their plea.

No interference is called for in respect of the present stage of the case in view of the learned Magistrate being in seisin at the final stages of the case.

With the aforesaid observations, the revisional application being CRR 3417 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
