The matter relates to premises no.5, Gurusaday Road, Ward No. 69, Borough-VIII of the Kolkata Municipal Corporation.

The petitioner filed the instant writ petition alleging certain illegal acts on the part of the private respondents and not taking steps in accordance with the direction passed in the order of the Director General (Building) on 16th February, 2023.

Presently, learned advocate appearing for the petitioner submits that the petitioner does not intend to proceed with the writ petition any further. A written instruction has been given by the petitioner to the learned advocate.

As the petitioner is not inclined to proceed with the writ petition any further, accordingly, the same stands dismissed as 'not pressed'.

Dismissal of the writ petition will, however, not stand in the way of the concerned authorities of the Corporation to ensure that no illegal act or unauthorized construction takes place at the subject premises.

The written instruction given by the petitioner to his learned advocate be taken on record.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
