Affidavit of service filed in Court today is taken on record.

The petitioner seeks higher scale of pay.

It has been submitted that the petitioner will be covered by the judgment of the Hon'ble Special Bench dated 7th February, 2024 passed in a bunch of writ petitions, one of which is WPA 303 of 2023 (Utpal Kanti Karan -vs- State of West Bengal & Ors.). 4.

A representation from the petitioner seeking higher scale of pay is pending consideration at the end of the authority.

Without entering into the merit of the said representation, the instant writ petition is disposed of by directing the District Inspector of Schools (S.E.), South 24-Parganas to consider and dispose of the petitioner's prayer for grant of higher scale of pay in accordance with law and in line with the judgment delivered by the Hon'ble Special Bench in the matter mentioned hereinabove after giving opportunity of hearing to the petitioner and all other necessary parties at the earliest but positively within a period of twelve weeks from the date of communication of this order.

If the prayer of the petitioner is allowed, then necessary consequential steps shall be taken by the authority without any further delay.

The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
