Applicants/Petitioners Mr. Mazhar Hossain Chowdhury Ms. Chandrima Debnath ...for the petitioners Mr. Soumik Ganguly Mr. Dipankar Paramanick ..for the State Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioners submits that other than the statement of a co-accused, there is hardly any incriminating materials available against the present petitioners. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He submits that when two accused were apprehended with the contraband, the present petitioners and the other accused came there and assaulted the raiding party members and snatched away the two accused from their custody. The petitioners are directly involved in this crime.

Considering the incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS, I do not consider this is to be a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail of the petitioners is rejected.
