Nauroz Rahber Ms. Anjana Mehebub, Mr. Muhammad Jawwad, Advocates ... for the petitioner Mr. Jahar Lal De, Mr. Rudranil De, Advocates ... for the State The allegation in this public interest petition relates to the irregularities and defalcation in implementing various projects under the Mahatma Gandhi National Rural Employment Guarantee Scheme at Jagdishpur-II Gram panchayat under the district Uttar Dinajpur.

It has been alleged by the petitioner that the authorities had withdrawn crores of rupees under the said scheme but have not implemented the projects. In the petition, certain projects relating to excavation of pond, creation of nursery, construction of roads, etc. have been mentioned, for which the funds were withdrawn, but the projects were not taken up or completed.

Learned counsel for the petitioner has pointed out that the petitioner has filed a detailed representation dated 12.09.2022 to the respondent No.4 (The District Magistrate, Uttar Dinajpur), but no action on the said representation has been taken till now.

WPA(P) 486 of 2022 Learned counsel for the State does not dispute that the grievances raised by the petitioner in the representation dated 12.09.2022 needs consideration. Hence, we dispose of the present petition by direction the respondent No.4 to duly look into the petitioner's grievances reflected in the representation dated 12.09.2022 and conduct an enquiry, if required, and take appropriate action after giving an opportunity of hearing to the petitioner and all the concerned respondents.

Let this exercise be completed within a period of three months from the date of receipt of the copy of this order.

The present petition is accordingly disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
