1. Affidavit of service be kept with the record.

2. The writ application has been preferred praying for setting aside of the award dated April 08, 2024 passed by the Learned Central Government Industrial Tribunal in connection with reference no.7 of 2003 pending disposal of the instant writ application.

3. It is submitted by the Learned Counsel for the petitioner that the tribunal disposed of the reference by passing a "No Dispute Award". It is submitted by the petitioner herein, that the matter

was being contested seriously by the senior Advocate, but he could not appear before the tribunal, subsequently as the Learned Counsel suddenly expired.

4. Considering the said submissions and in the interest of justice, the "No Dispute Award" is set aside and the writ application is disposed of with the direction that the reference Case No.07 of 2003 being restored to its own file, be heard by the tribunal, afresh, by granting an opportunity to the petitioner herein, to place their case and by passing a reasoned order, in accordance with law.

5. It is made clear that in case the petitioner herein fails to appear before the tribunal, on the date fixed by the tribunal without any reasonable excuse, the tribunal will be at liberty to proceed with the appeal, in accordance with law.

6. WPA 22109 of 2025 is disposed of.

7. Applications, if any, connected thereto stand disposed of consequently.

8. Interim order, if any, stands vacated.

Photostat certified copy of this order, if applied for, be given to the parties on priority basis upon compliance of all formalities.
