Learned advocate appearing for the petitioners submits that petitioners are senior citizens who have been thrown out of their residence at the behest of the private respondent who has been flexing muscles with the aid of local anti-social elements. Petitioners submit that they have refunded the amount which was taken from them for using a part of the property, but the private respondent has in fact flexed his muscles and occupied whole of the property, to that effect, informations have been furnished before the local police station but the same did not yield any result.

Mr. Ghosh, learned advocate appearing on behalf of the State has submitted a report. Report reflects that police authorities have drawn up

proceedings under section 107 of the Code of Criminal Procedure.

Since the petitioners have preferred an application under section 156(3) Cr.P.C. a report has been filed before the jurisdictional court.

It has been informed by the learned advocate appearing for the petitioners that a title suit has been preferred. If any application for ad interim injunction is pending before the civil court, I direct the civil court to put in efforts so that the same can be considered and disposed of by the said court within a period of 60 days from the date of communication of this order. With the aforesaid observations WPA 22288 of 2024 is disposed of.

Report so submitted be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
