1. This application under Article of the Constitution of India is at the instance of respondent in Title Appeal No. 191 of 2019 praying for direction upon the learned Additional District Judge, 3rd Court at Alipore to dispose of the injunction application filed in the title appeal as well as title appeal expeditiously.

2. The opposite parties are represented by their learned Advocate. The petitioners are directed to serve a copy of this application upon the learned Advocate representing opposite parties and the same has already been served upon them.

3. Learned Advocate for the petitioners submits that an application for temporary injunction in the title appeal is still pending. He further submits that t he date of hearing of such application is 18th December 2025.

4. In the light of the submission made by the learned Advocate for the petitioners, CO 3402 of 2025 stands disposed of by requesting the learned Additional District Judge, 3rd Court at Alipore to take up the application for injunction on the next

date fixed i.e. on 18th December 2025, if it is ready for hearing and to dispose of it as expeditiously as possible preferably within a period of eight weeks from the next date fixed. After disposal of the said application as well as the other applications, that may be pending, the learned Additional District Judge, 3rd Court at Alipore shall make endeavour to dispose of the said title appeal as expeditiously as possible without granting any unnecessary adjournments to either of the parties keeping in mind that the title appeal is pending since 2019.
