It is the grievance of the petitioner that he retired as a Group-D staff of Contai Municipality on May 31, 2021. After his retirement, his pension payment order was issued on March 19, 2024. The petitioner is now receiving pension in terms of the said pension payment order but the arrear pension and gratuity have not been paid.

The Municipality submits that towards the gratuity, only a sum of Rs.1,00,000/- (Rupees one lakh) has been paid to the petitioner. It, however, does not dispute that the remaining gratuity amount and the arrear pension has not been paid. It is further submitted before this Court that the said dues shall be paid shortly.

In that view of the matter, there is no need to keep this writ petition pending.

Accordingly, I dispose of this writ petition with a direction upon Contai Municipality to release the unpaid dues of the petitioner including gratuity and arrear pension amount within a period of two months from date.

The petitioner will be further entitled to interest @ 6% per annum from the date of issuance of pension payment order i.e. March 19, 2024 till the date of actual payment on the unpaid gratuity amount. Accordingly, WPA 22286 of 2024 is disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties on compliance of usual legal formalities.
