Present petition has been filed for expeditious disposal of the proceeding being Matrimonial Suit no. 91 of 2015 (new number Matrimonial Suit No. 40 of 2019). 2.

Perusal of the record indicates that for expeditious disposal of the same Matrimonial Suit no. 91 of 2015, an earlier petition was filed bearing CO 1591 of 2018 in which the Co-ordinate Bench of this Court vide order dated 3rd September, 2018 passed an order for expeditious disposal.

Learned counsel for the petitioner submits that despite the order the disposal has not been done as the considerable time elapsed in reconstruction of record on account of destruction of the same on fire. Since there is already an order of expeditious disposal, the Court considers that the present petition cannot be entertained. The petitioner should have persuaded the learned Trial Court for compliance of the earlier order of the Co-ordinate Bench dated 3rd September, 2018.

In the circumstances, no further order can be passed in the present petition, in any case learned Trial Court would be bound by the direction of this Court in CO 1591 of 2018 dated 3rd September, 2018 for expeditious disposal.

Hence, the present petition stands disposed of. 6.

All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
