C.R.R 3630 of 2022 In Re : An application under Section 397, 401 and Section 482 of the Code of Criminal Procedure, 1973.

In Re :Tara Shankar Kundu ....Petitioner Mr. Pawan Kumar Gupta Mr. Arnab Saha Ms. Sofia Nesar Mr. R. D. Nandy ......for the petitioner Mr. Nandy, learned Advocate appearing for the State has drawn attention of this Court that the anticipatory bail before the learned Sessions Judge, Purulia was rejected on 29th August, 2022.

However, the warrant of arrest was pending earlier and according to the petitioner the same weighed with the learned court along with the material produced by the State for rejecting his prayer for anticipatory bail.

The Petitioner intends to prefer an application for anticipatory bail before the Hon'ble High Court at Calcutta.

In view of the prayer so advanced and as undertaken by Mr. Pawan Kumar Gupta, learned Advocate appearing for the petitioner that the petitioner is

ready and willing to appear before the investigating officer. The warrant of arrest so issued be stayed till 23rd October, 2022. The Investigating officer is directed not to take any coercive steps till 23rd October, 2022. The petitioner will go and meet with the investigating officer on 17th October, 2022 and as and when he would be subsequently directed. In case the petitioner do not exhaust the remedy as prayed for under law, the investigating officer will be at liberty to exercise his authority under the law on and from 24th of October, 2022.

With the aforesaid observations CRR 3630 of 2022 is disposed of.
