1. Since the learned advocate for the petitioner would submit that there are formal defects in the writ petition, he seeks to withdraw the same with liberty to file afresh on the self-same cause of action.

2. Mr. Banerjee, learned advocate representing the Bally municipality would submit that he does not have any objection to the same.

3. In view of the above, let this matter stand dismissed as withdrawn with liberty to file afresh on the self-same cause of the action.
