It is submitted on behalf of the learned Advocate for the petitioner that he is in custody for more than one year and the trial has substantially progressed and two more witnesses are yet to be examined. It is further submitted that he has been falsely implicated in this case and he is no way connected with the alleged offence.

The learned prosecutor raises strong objection. 3.
Having heard the learned prosecutor it can be found that the accused against whom the allegation to supply the fake foreign currency was made has been enlarged on bail. Moreover, the trial has commenced substantially and on the verge of completion and, therefore, considering the period of detention and
that almost vital witnesses have been examined, this Court is inclined to allow the prayer for bail.

Accordingly, the petitioner, namely, Rajesh Saikh @ Rajesh Seikh @ Rajib Uddin Sk. @ Rajesh Sk., be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned A.C.J.M., Kandi, Murshidabad. The petitioner shall appear before the trial Court on each and every date of substantive hearing subject to the provisions of Section 317 of the Code of Criminal Procedure, 1973/Section 355 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever.

In the event the petitioner fails to comply with any of the conditions stipulated above, the trial Court shall be at liberty to cancel the bail in accordance with law without further reference to this Court.

The application for bail is, thus, disposed of. 7.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
