1. In view of Section 438(4) of the Code of Criminal Procedure, an application for anticipatory bail is not maintainable for an offence committed under Section 376(3) of the Indian Penal Code.

2. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
