Report submitted by the learned advocate appearing for the State be also kept with the record. Petitioner happens to be brother of the deceased while the private respondent no.5 happens to be the erstwhile wife of the deceased. Learned advocate appearing for the State submits that the petitioner has constructed a property and is enjoying the same.

On the other hand, learned advocate appearing for the respondent no.5 disputes the death certificate itself and submits that the death of her husband took place in the year 1992 and the death certificate which has been enclosed by the petitioner is of the year 2001. The gift which has taken place, according to the respondent no.5, is questionable as the same is executed in the year 1993.

Be that as it may, there are trappings of feud amongst acquaintances. Prima facie it reflects that the petitioner is only expressing his agony for being disturbed by the respondent no.5.

The respondent no.5, on the other hand, is disputing the death certificate.

Both the parties are in a strained relationship. I do not find that any cognizable offence is made out so far as the petitioner is concerned. Police authorities, as such, would keep a vigil and ensure that no breach of the peace takes place.

With the aforesaid observations, the writ petition being WPA 21972 of 2025 is disposed of. There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
