Heard learned counsels for the parties.

It is submitted on behalf of the petitioners that the land of the petitioners was acquired and the petitioners received compensation for the same. But no compensation has been received by them for the structure standing on the said land which was demolished by the authorities at the time of acquisition.

The petitioners submitted a representation before the concerned authority on 4th August, 2022 claiming compensation in respect of the structure standing on the land in question, which was forwarded to the Additional District Magistrate (Land Acquisition) and Competent Authority of Land Acquisition, Malda by the Assistant

Commissioner, Malda Division, Malda. The petitioners seek consideration of their representation at the earliest. It is submitted on behalf of the respondents that the 3rd respondent be directed to consider the representation in accordance with law.

In view of the above, the writ petition is disposed of directing the 3rd respondent to consider and dispose of the representation submitted by the petitioners dated 4th August, 2022 within two months from the date of communication of this order upon affording reasonable opportunity of hearing to all the interested persons including the petitioners, in accordance with law. With the above observations and directions the writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
