Smt. Metel Panda Mr. Jagannath Ganguly ....for the petitioner This application under Article of the Constitution of India is at the instance of the husband praying for a direction upon the learned Additional District Judge, Fast Track, 2nd Court at Howrah to dispose of the Matrimonial Suit No.377 of 2022 expeditiously.

The learned advocate appearing for the petitioner submits that the wife/opposite party has sufficient income of her own and she has not applied for alimony or maintenance in the matrimonial suit. He further submits that the application filed by the wife/opposite party praying for maintenance under the provisions of Section 125 of the Criminal Procedure Code stood rejected. He further submits that the matrimonial suit is at the stage of evidence of the plaintiff.

In view of the order sought and proposed to be passed this Court feels that there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned

advocates representing the opposite parties before the learned trial judge.

From the order sheets appended to this application, this Court finds that September 26, 2025 has been fixed for cross-examination of P.W.1.

The learned advocate for the petitioner submits that the suit was filed in the year 2020 and after transfer of the suit to the present Court it has been renumbered as Matrimonial Suit No.377 of 2022.

In the light of the submission made by the learned advocate for the petitioner, CO 3403 of 2025 stands disposed of by requesting the learned Additional District Judge, Fast Track, 2nd Court at Howrah to dispose of the Matrimonial Suit No.377 of 2022 as expeditiously as possible but preferably within a period of 9 months from the next date fixed, without granting any unnecessary adjournments to either of the parties.

This order has been passed taking note of the fact that the suit is pending from the year 2020.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
