The petitioner is aggrieved that an order of the controlling authority dated October 6, 2021, directing the private respondent employer to pay gratuity to the petitioner is pending enforcement and execution in certificate proceeding No. 393/Cert/How dated 04.01.2022.

This Court directs that the said certificate proceeding should be disposed of mandatorily and positively by the Certificate Officer, Howrah, within a period of one month from date.

The private respondent, subject to any appeal or stay, is also directed to make

payment within the same period of one month, failing which the Certificate Officer shall take steps in accordance with the 1972 Act.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of this judgment, if applied for, be given to the parties upon compliance of all formalities.
