1. By filing this public interest litigation the petitioner alleges that there is illegal construction made by the private respondent upon converting the land in question.

2. Learned advocate for the State/respondent submitted that the petitioner himself has purchased a portion of the land in question.

3. If that be the case, this matter cannot be treated as public interest litigation.

Therefore, the same is dismissed.

However, the representation given by the petitioner can be pursued before the authority and it is expected that the

authority should proceed to take action in accordance with law as stated in the report filed by the Block Land and Land Reforms Officer, Joynagar-II, South 24 Parganas by memo no.1980/BDO JOYII dated 12.09.2024. ( T.S. Sivagnanam ) (Chief Justice) ( Hiranmay Bhattacharyya, J. )
