1. Heard learned Counsel for the parties.

2. The petitioner is alleged to have duped the informant, who is a lady of Rs. 22 lakhs for getting admission for her (informant's) daughter in MBBS course at SSKM College and Hospital, Kolkata.

3. The entire amount is alleged to have been paid through cash.

4. In view of the nature of allegation and the transaction, we feel that there is justification of custodial interrogation. In view of the gravity of offence, we are not inclined to exercise our discretion in favour of the petitioner under Section 438 Cr.P.C.

5. Accordingly, the prayer for anticipatory bail is rejected.

6. The application being CRM (A) 3995 of 2023 is dismissed. (Chitta Ranjan Dash, J.) (Partha Sarathi Sen, J.)
