Pattanayak ...for the Petitioner Mr. Malay Kumar Singh, Mr. Tapas Chatterjee ...for the State 05-09-2024 AKG Ct. 15 In substance, the petitioner challenges a notice inviting e-auction dated August 22, 2024, for grant of ferry ghat lease for Taranpur Ferry Ghat under Nabadwip Panchayat Samity.

The petitioner submits that the said tender notice contains several ambiguous clauses. The petitioner by a letter dated August 29, 2024, sought for clarifications with regard to the said clauses. Without the clarification, being provided to the petitioner, Nabadwip Panchayat Samity has proceeded with the tender notice.

The last date for submission of bid was September 3, 2024.

Learned advocate appearing for the State, on instruction, submits that the Panchayat Samity shall accept the bid of the petitioner as a special case beyond the last date of submission and consider his bid in accordance with law along with the other competing bids.

In view of the respective stance of the parties before this Court, I do not see any justification to delve into the allegations made in this writ petition. In that view of the matter, this writ petition is disposed of with a direction upon the petitioner to submit his bid before the Nabadwip Panchayat Samity by 6:00 PM tomorrow (06.09.2024). The Nabadwip Panchayat Samity shall keep the relevant web portal open for accepting the bid of the petitioner for one day i.e. 6th September, 2024, till 6:00 PM.

If the petitioner submits his bid, the same shall be considered for the e-auction in accordance with law. WPA 22246 of 2024 is disposed of.

Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
