His appearance may be regularised by the concerned authority. Learned Advocate for the petitioner submits that in connection with Jetia P.S. Case No. 135 of 2022 chargesheet has been filed and the case has been committed to the ld. Sessions Court and is presently pending before the Ld. Additional District & Sessions Judge, Fast Track 3rd Court, Barrackpore.

Learned Advocate submits that charge was framed on 10th of May, 2023 but till date out of seven chargesheeted witnesses, only a part of examination-in-chief of P.W.1 has been completed. Next date has been fixed on or about 22nd September, 2023.

Having regard to the contentions so advanced by the petitioner and the manner in which the trial is progressing, I am of the view that there is justified progress in the trial. However, if the witness is not appearing, then the ld. Sessions Court/Trial Court would communicate with the SDPO/DSP/ASP -in-charge of Jetia P.S., who would ensure regarding presence of the witnesses on the next date so fixed by the trial Court.

The ld. Trial Court would fix a schedule consisting of three dates and fix such schedule once in every sixty days, so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment may be granted to either of the parties. All efforts must be taken to conclude the trial at the earliest.

With the aforesaid observations, CRR 3426 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.
