Petitioners are aggrieved by the fact that the private respondents are disturbing the peaceful possession of the petitioner's property and attempting to encroach upon their property.

To that effect, information has been furnished with the police authorities, but according to the petitioners the police authorities did not take any effective steps.

Learned advocate for the State submits that the expectations of the petitioners are that the recovery of the possession would be at the instance of the police authorities. State has submitted a report. The report reflects that police authorities have been vigilant and they have already instituted proceedings under section 126/135(3) of the BNSS.

I am of the view that since the parties are at loggerhead, police authorities would continue to keep a strict surveillance so that no breach of the peace and tranquility takes place or any untoward incident results because of the inimical relationship existing between the parties.

With the aforesaid observations WPA 22351 of 2024 is disposed of.

Report so submitted be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
