Mr. Anjan Bhattacharya Ms. Anita Shaw ..for the petitioner Mr. Arindam Sen Mr. Sagnik Bhattacharya Mr. Rishav Gupta ..for the private respondent no.8 Mr. Biswabrata Basu Mallick Mr. Sanjib Das ..for the State The allegation of the petitioner, who is father of a child of the school, is that the Prodhan of the concerned Gram Panchayat is working as a teacher in the school.

The Commissioner of School Education is directed to make an enquiry through his appropriate officer as to the allegation in this matter whether the private respondent no.8 acted both as a Prodhan and as a teacher of the primary school. He did it according to the allegation for the last five years i.e. from 2018 to 2023. The respondent no.8 is present through his learned advocate has stated that his client is not Prodhan now. However, he was Prodhan for last five years i.e. from 2018 to 2023. Appropriate steps is

required to be taken against the private respondent by the School Education Department for continuing service in the school without taking any lien or leave as has been alleged by the petitioner and for this purpose hearing is to be given to the private respondent and also to the petitioner when they shall have the liberty to be present through their learned advocates. The whole matter is to be decided within a period of eight weeks from the date of communication of this order.

With the above observation and direction, this writ application is disposed of.
