The petitioner is a day labourer. He has been falsely implicated. Actually, he was also a victim. His phone was hacked and the SIM was used to commit a crime. In fact, at the relevant time, the SIM was not working.

Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. He submits that the de facto complainant had taken a home loan and was about to deal with LIC in this regard. He was given a phone number of a Branch Manager of Shahpur Branch of the SBI in Bihar. However, the offending call had come from the phone number of the present petitioner. Bank details were taken and huge sums of money taken out from the petitioner's bank account. The petitioner has not co-operated with the investigation by responding to the notice given.

Considering the incriminating materials available in the case diary and the fact that the petitioner has not responded to the notice given by the Investigating Agency, I do not consider this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail of the petitioner is rejected.
