The learned Advocate for the petitioners submits that in terms of a development agreement the private respondents have constructed a multistoried building but have not handed over possession of the entire share of the owners allocation. Such submission is, however, disputed by the learned Advocate for the private respondents. After hearing the learned Advocates for the parties, it appears to this court that the dispute between the private parties have arisen pursuant to a development agreement. Such a dispute is purely a civil dispute.

This court is, therefore, not inclined to grant any relief to the petitioners in this writ petition.

Petitioners are left free to approach the proper forum for appropriate reliefs in accordance with law. The report of the Inspector in-Charge, Diamond Harbour Police Station, Diamond Harbour Police District dated 10.09.2024 filed by Mr. Das, learned Advocates for the State is taken on record. Accordingly, the writ petition stands disposed of.

There will be no order as to costs.

Urgent certified copy of this order, if applied for, be given to the learned advocates for the parties on usual formalities.
