The petitioner submits that inspite of the decree being passed by the learned Civil Judge (Jr.Divn.), Kakdwip in TS 142 of 2021 thereby restraining the defendants from any disturbances in the peaceful possession of the plaintiff/the petitioner herein, the defendants have been carrying out their illegal activities.

Learned advocate for the respondent no.5 submits that a Misc.

Appeal has been preferred against the said order which is pending before the

Appellate Court.

The petitioner also contends regarding the threats, abuse as well as assault being inflicted with some weapons and an attempt for breach of the peace at the behest of the private respondents.

State has submitted a report which reflects that a long standing land dispute is existing between the petitioner and the private respondents. The police authorities already have drawn up a proceeding under Section 126 of the BNSS.

In case, there is any violation of the civil court's order, the petitioner would be at liberty to approach the said civil court which has passed the decree in favour of the petitioner.

So far as the police authorities are concerned, they would keep overall vigil and surveillance so that none of the parties are able to breach the peace and

tranquility and/or create any untoward situation which may violate the law and order.

With the aforesaid observations, WPA 22024 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report submitted by the State be kept with the record. Copies of the report be handed over to both the parties.
