1. Heard the learned counsels for the parties.

2. Perused the case diary.

3. Although the injury report names all the petitioners as the assailants, the victim in his statement before the police had taken the name of the present petitioner no. 1, who allegedly assaulted him with a stick on his head.

4. It appears from the injury report that there was an injury, which required stitches on the scalp of the victim.

5. In view of the same and considering the other materials available in the case diary while I am inclined to grant anticipatory bail to the petitioner nos. 2 (Mira Haldar) and

3 (Apan Haldar @ Arpan Haldar), the application for anticipatory bail of the petitioner no. 1 (Anjan Haldar @ Soumen Haldar) is rejected.

6. In the event of arrest, the petitioner nos. 2 and 3 shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the said petitioners shall cooperate with the investigation and shall not threaten or intimidate witnesses. The petitioner no. 3 shall meet the Investigating Officer once a fortnight till submission of report in final form.

7. Accordingly, the application for anticipatory bail is allowed-in-part.

8. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
