Upon perusal of the reasons enumerated in the application as above and finding the same to be sufficient, the prayer of the applicant/writ petitioner is allowed.

The delay of sixty four (64) days in filing the application being CAN 1 of 2023 is condoned.

Let the order dated January 31, 2023 passed in WPA 20250 of 2016 be recalled.

Let the writ petition being WPA no. 20250 of 2016 be restored in its original file and number. Conceding to the prayer made by Ms. Iti Dutta, learned counsel for the State, time for filing affidavit-inopposition is being extended hereby till two weeks after vacation.

Affidavit-in-reply, if any, be filed within one week thereafter.

Let the matter appear in the monthly list of December, 2024.
