The writ petitioner is aggrieved that the Domkal Police Station has not been able to execute a warrant against the private respondent, Sakim Sk for failure to pay maintenance under Section 125 of the Cr. P.C. The Chief Judicial Magistrate, Berhampore, Murshidabad has issued the warrant of arrest. It appears that repeated attempts have been made by the police to execute the warrant but the accused is absconding.

A report that warrant could not be executed has been submitted before the Magistrate and further time has been sought.

The petitioner may approach the Magistrate for further measures for the purpose of compelling the said Sakim Sk to pay maintenance in the court below, inter alia, by seeking orders of proclamation and attachment. The report of the Domkal Police Station dated 22.02.2023 is kept with the record.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There shall be no order as to costs.
