The primary grievance of the petitioners is directed against the State respondents in carrying out demolition of any structure in the subject premises. The petitioners rely on an order passed in WP 5652 (W) of 2019 (Dilip Kumar Halder vs. The State of West Bengal & Ors.) and contends that notwithstanding the respondent no.5 having been directed to visit the locale and prepare a site plan, the same has not been completed.

Mr. De appearing on behalf of the State respondents and relies on a notice dated 23rd March, 2019 issued by the Assistant Engineer, P.W.D. Joynagar Sub-Division and contends that due to heavy downpour the necessary demarcation could not take place. He prays for time to the State authorities complete the demarcation within three months from date.

In view of the submissions made on behalf of the State, the State respondents are directed to complete

the demarcation in terms of the order dated 20th March, 2019 passed in WP No. 5652 (W) of 2019 within a period of three months from date.

With the aforesaid directions, WPA 19969 of 2019 stands disposed off.
